Many criminal defense cases involve identity thefts in Florida

Regardless of the crime of which a person in Florida is accused, he or she is presumed innocent unless proved otherwise in court. In fact, this is the case for anyone charged with any type of crime throughout the nation, but criminal defense options vary according to particular circumstances. Of late, many situations have to do with identity theft, which seems to be occurring more regularly since computer chips were placed in credit cards.

Many financial institutions have encouraged customers to trade in their old-style credit cards for the new kind that contain the chips. Some people thought that by using the new cards, there would be less chance of having their identities stolen. However, authorities claim to have found evidence of identity theft using such cards when they responded to a hit-and-run accident.

Inside the vehicle involved in the accident, there were reportedly credit cards with certain individuals' names on the cards but other persons' information on the encoded magnetic strips. Authorities say they also found Social Security cards, military identification cards and gift cards in the vehicle. Officials say the man responsible for the vehicle admitted to re-encoding the cards using a special device.

In Florida, and all other states, anything a person says to police officers during an investigation can later be used as incriminating evidence. Therefore, it is always best to request guidance from an experienced criminal defense attorney before answering any questions or admitting to any wrongdoing. An experienced attorney can help determine how best to proceed in a particular situation.
