Drug charges filed after police force their way into Florida home

Florida citizens and others throughout the nation are protected under the Fourth Amendment against any unlawful searches and seizures of their homes, property or person. This may wind up being a central focus regarding the defense of several people who are currently facing serious drug charges in this state. The events unfolded on a recent Saturday when police officers arrived at a private residence, supposedly to serve a search warrant.

Narcotics investigators claim other residents in the area issued complaints about a particular residence. They also allege that officers went to the house after a search warrant was executed. However, the officers claim no one responded to their knocks on the door. Apparently, they stormed the house and forced their way inside.

Five people were arrested and charged with various crimes. Most of the charges are drug-related although one person was charged for resisting an officer who says the man ran away from the house. The officers who forced their way into the house say they seized methamphetamine drugs, as well as morphine, other drugs and drug paraphernalia.

Authorities say one of the people inside the home was taken to a nearby hospital for treatment of an apparent drug overdose. He was also charged with drug trafficking and possession of marijuana and paraphernalia. Even under circumstances where serious drug charges are filed in Florida, any person accused has a right to present as strong a defense as possible. If a person thinks his or her civil rights have been violated in the process of investigation or arrest, an experienced criminal defense attorney can further investigate the situation to determine whether grounds exist to submit a challenge to proffered evidence in court.
