Seeking clarification regarding drunk driving laws in Florida

In Florida and all other states, operating a motor vehicle with a blood alcohol content level exceeding the legal limit is punishable by law. As soon as someone is charged with drunk driving, an automatic process begins to unfold. A person under suspicion is bound to face several immediate challenges regarding personal rights, potential consequences and other issues.

When a motorist is pulled over in a traffic stop and an officer claims that the driver is suspected of impaired driving, that person may be requested to undergo certain field sobriety tests. One of the decisions with which the driver would immediately be faced is whether to submit to the officer's requests. In many states, there are automatic consequences for refusing to take a Breathalyzer or other on-site test.

Since anything said by those questioned by police in such situations can later be used to incriminate them, it is typically advisable to request immediate defense assistance before submitting to any line of questioning. Also, there are zero tolerance laws in all states that target drivers under the age for legal consumption of alcohol. Such persons may be penalized for conviction of intoxicated driving with even negligible amounts of alcohol detected in their blood.

In Florida and all other states, officers often arrest people for drunk driving without definitive chemical proof of intoxication. In fact, convictions may be handed down if other evidence of impaired driving is shown, such as an officer's testimony that a vehicle was seen swerving or moving erratically on the road. To possibly avoid conviction and minimize the potential negative effects of a situation, a defendant can enlist the help of an experienced criminal attorney to fight against charges in court.
