Man faces domestic violence charges in Florida

One man is in a sticky situation in Florida after being arrested for domestic violence following an argument involving peanut butter and jelly. Even if a person is charged with domestic violence, this does not mean he or she is automatically guilty in the eyes of the law. An accused individual is always presumed innocent until and unless proved guilty by the prosecution.

Police said the incident occurred on a Sunday when the 46-year-old man woke up to fix himself a peanut butter sandwich. However, he reportedly become angry upon finding out that no jelly was in the home. That is when an argument allegedly started between the man and his wife.

Police said while the two were arguing, the wife ended up spilling milk on the floor. They said the man then pushed his wife, forcing her to strike the ground. They said he then held the woman there and used her head to wipe up the milk that had spilled. Authorities said the woman showed them areas of her arm that had been bruised. The man now faces domestic violence battery charges.

The man accused of domestic violence in Florida has the right to vigorously fight the charges at trial. The charges must be proved beyond a reasonable doubt before a conviction can be secured. Prosecutors may also offer the man a plea deal, which may offer the advantage of leading to a lighter sentence for the accused. A thorough analysis of the evidence that the prosecution intends to provide to support the accusation might be a major area of focus for defense counsel in determining the best way to proceed before the court in this type of criminal case.
