Fatal Florida accident blamed on drunk driving

A Florida man from Naples was recently charged with DUI. The drunk driving arrest was made following a car accident that killed a man and injured a woman. The accused man has multiple traffic infractions on his arrest record, including speeding and failure to exercise care behind the wheel.

Police reported that the man was operating a vehicle east on a boulevard on a Saturday when his automobile crashed into a sport utility vehicle in front of him. The SUV spun out of control, crossed the median of the road and veered into the westbound lanes. An oncoming minivan collided with the SUV before spinning and flipping.

The 33-year-old male driver of the minivan, the dad of four children, was transported to the hospital. He died there. Meanwhile, the 41-year-old woman driving the SUV suffered serious injuries in the crash. The man believed to have caused the crash suffered no injuries; he was arrested on a total of 14 charges, including DUI manslaughter as well as leaving a crash scene.

People who have been accused of drunk driving in Florida have the right to go to trial to challenge the accusations. At trial, the prosecution has to prove the charges beyond a reasonable doubt before a criminal conviction is possible. Alternatively, a defendant may choose to plea bargain with the prosecution instead of going to trial, if given the opportunity, which may lead to a lighter sentence than would likely be imposed if convicted after trial. Alongside his defense counsel, this man will need to make a number of important decisions as his case progresses through the court system.
