Strong criminal defense important for man accused of DUI

One man in Florida has been accused of drinking and driving and causing a fatal accident. The accident took place on a Monday. The man, however, has denied the accusations, pleading not guilty to a DUI manslaughter charge. The man's criminal defense in this situation will strive for an outcome that is in his best interests.

The accident took place at around 7 p.m. when a man, 53, was assisting with the clearing away of debris from the roadway. All of a sudden, he was hit by an automobile and killed. At the time of the accident, the victim, who had been driving a concrete-pouring truck when he stopped to help with the debris, was wearing a hardhat and reflective vest.

Police said the man who struck the 53-year-old smelled of alcohol, but he chose not to perform a sobriety test or complete a blood alcohol level test. In addition to facing a DUI manslaughter charge, the man faced charges of not agreeing to complete a blood alcohol test at the accident scene as well as possessing fewer than 20 grams of pot. However, prosecutors said they would not be taking any action on the latter counts. His bond was set at a total of $45,000.

A person facing DUI and other criminal charges has the right to proceed directly to trial on the merits. At trial, prosecutors must prove the charges by relevant evidence; otherwise, the defendant cannot be convicted. However, the person may also be offered an opportunity, alongside his or her criminal defense counsel, to plea bargain with the prosecution. A plea deal might result in a lighter sentence than what would be imposed if the person were to be found guilty in court. Either way, the defendant charged with DUI is entitled to the same legal protections guaranteed to people facing other types of criminal charges in Florida.
