Prison time may result from convictions on porn-related felonies

One man in Florida is facing a felony charge after reportedly exposing children to pornography by using his cellular phone. Being charged with these types of felonies may lead to time in prison if a conviction is ultimately secured by prosecutors. However, the individual is presumed innocent until and unless guilt is established by government prosecutors in court and beyond a reasonable doubt.

In the recent Florida case, police said the man was teaching a high school freshman reading class when a student approached him to ask him a question. She reportedly spotted gay pornography on his iPhone, which was face up on the man's desk. That is when she used her phone to capture a brief video of his illicit images; then, she apparently shared the video with police and put it on Snapchat. Police said they believed that the man intended to display the porn.

Three other pupils in the class reportedly saw the porn as well. Police said the teacher had been on a sex-sharing and dating site for gay men more than 380 times in the past couple of weeks at the high school. He is currently on paid administrative leave as police investigate the alleged crime.

If appropriate, the man's defense counsel might explore the opportunity to strike a plea deal with the prosecution. A plea agreement might offer the advantage of leading to lower charges and/or a reduced sentence for the accused person, compared with what may result following a guilty verdict after a trial. Nevertheless, those accused of felonies also have the right to proceed to trial, where the prosecution will be forced to prove the formal accusations according to the strict requirements of the Florida criminal justice system.
